Patient App Privacy Policy

Percipio Health and its affiliates and subsidiaries (collectively, “Percipio Health”, “Company”, “Us”, “Our”, or “We”) respect and value the privacy of our end users, including patients, members, and clinicians. This Privacy Policy explains how We collect, use, disclose, and safeguard information associated with the users of Our website and web and mobile applications (“Platforms”).
Please note that the health information that We collect through the Platforms may be subject to the federal Health Insurance Portability and Accountability Act of 1996, as amended, and its implementing regulations (“HIPAA”). We only collect, process, and handle health information on behalf of Our health care provider and health plan customers under the business associate agreements (BAAs) that are in place with those customers who are subject to HIPAA. Under those circumstances, such information will be subject to our customers’ notice of privacy practices. This policy applies to the Platforms that We own or operate and that contain a link to this policy. This policy applies to all individuals with whom We interact or from whom We collect information through the use of the Platforms. As stated above, this Policy does not apply to any information subject to Our customers’ notice of privacy practices. While certain information we collect and use will be controlled by Our customers, this policy provides an overview of all of the information we may collect from you to ensure you have a full understanding of the scope of our information practices.

For the purpose of a clinical review of an individual’s’ health status, We may collect the following types of information provided by you via the Platforms:
Personal Identification Information (e.g., name, date of birth, address, email)
Historical Health Information (e.g., medical history, diagnosis, treatment plans)
Current Clinical Data (e.g., heart rate, blood pressure, medications, depression, mood)
Communication with Clinicians (e.g., messages, consultation notes)
For the operation and improvement of the Platforms and their features, We may collect the following types of information:
Web and mobile application usage information
Mobile phone OS version (e.g., Android 15, iOS 13)
Web browser version (e.g., Chrome 120.0.6099.28)
Percipio Health app version (e.g., Percipio Health 1.0.3)
We do not deploy any third-party cookies or similar tracking technologies on our Platforms.
3. How We Use Your Information
We may use the information We collect for the following purposes:
Health Assessment: To allow clinician users to review and assess the health of individual users.
Security: To provide authorized clinicians with secure access to an individual’s data, including management of user accounts. Your information may also be used to confirm your identity, facilitate your registration, manage your account, and to deliver the information, products, or services you seek.
Communications: To facilitate secure communications between individuals and clinical end users, as well as communications with Us.
Technical Support: To support the functionality of the Platforms.
Platforms’ Improvements: To improve Our Platforms’ offerings based upon usage and information We receive from you.
Contractual Obligations: To carry out Our obligations and enforce our rights arising from any contracts entered into between you and Us, such as the Terms of Use to use the Platforms.
Remaining Uses: In accordance with and to the extent permitted by HIPAA, and for any other purposes with your consent.
4. Disclosure of Your Information
We do not sell, trade, or rent individual personal identification or health information to others, including any information governed by our customers’ notice of privacy practices. We may share generic aggregated demographic information not linked to any personal identification information regarding users and patients/members with our business partners and trusted affiliates for the purposes outlined above. In furtherance of your use of the Platforms, we may disclose your information to the following parties:
Our subsidiaries and affiliates;
Contractors, service providers, and other third parties We use to support our business;
To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Company about the Platforms’ users is among the assets transferred;
All above exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties;

To enforce or apply our Terms of Use and other agreements, including for billing and collection purposes; and

Security measures to protect against unauthorized access, alteration, disclosure, or destruction of HIPAA-regulated information.
6. Children Under the Age of 13
The Platforms are not intended to be utilized by children under 13 years of age but may be utilized by parents/guardians of the child(ren) to assist with managing their child(ren)'s health.
